Internet based communications service providers who are not collecting and remitting State and Local sales taxes in the United States may be at risk; and some that are, may be over-collecting.
Cloud Communications service providers have long been perplexed by the question of collecting and remitting these taxes. Some bill and collect state and local taxes ("SALT"), while others do not. Some think that the "test" that determines whether they must comply with SALT has to do with having their "physical presence" in a particular state. Others think that having one customer is enough to require sales tax collection. Some just continue to duck their heads in the sand!
